1. Object
The object of these general conditions is to define the terms of a collaboration between Pushdate France and the affiliate.

2. Prerequisites
Participation in the affiliate program requires the following:
- ownership of the Internet site
- having read and agreed to the General Conditions of Affiliation,
- and having filled in the online registration form, the affiliate being clearly and honestly identified.
The affiliate must supply a valid email address to be easily contacted by Pushdate France.
The affiliate will only be considered an affiliate when their Pushdate contract of affiliation has been duly signed and returned.

3. Membership
To join our affiliate program, you must fill in and submit the registration form on the Pushdate.fr site. Your application will be evaluated by our services to verify that your site respects our ethics and its technical characteristics are compatible with Pushdate technology. In the event it does not fulfill the conditions, you will be informed by email of the rejection of your program registration, and this within 72 hours following receipt of your application. Your application can be refused if your site:
- encourages violence - is discriminatory, in terms of race, sex, religion, nationality and also in relation to an incapacity or handicap of any kind, sexual orientation, or age
- encourages or conducts illegal activities
- infringes certain rights of intellectual property
- is of a pornographic nature
- is technically incompatible with Pushdate technology
- or for any other reason deemed, at our sole discretion, as being damaging to the Pushdate image.
After program acceptance and making of the contract, we reserve the right to cancel your membership at any time, once your site ceases to comply with the first 5 conditions above.

4. Service
Pushdate offers a mutualized dating service through its international affiliate network. Pushdate integration technology allows affiliates to dispose of customized dating services on their sites. All of the service functionalities available to users are described in the contract signed by both parties. Pushdate reserves the right, at any time and by right, to improve, alter or add new functionalities to its technology or services, with one week's advance notice by electronic mail, before their operational implementation on the service.

5. Preparation of setting up the service
Annex to the contract, Setting up the Service, defining, with specifics, the technical phases in the preparation of placing the service on line and the different types of files needed for this purpose. Setting up the service requires the creation of a subdomain on Pushdate servers. This subdomain can take the name of the affiliate site, if desired, e.g.: nameofyoursite.pushdate.com. The affiliate shall collaborate technically, after signature of contract, so that the placing online of the service can be effective within 3 to 15 days from receipt by Pushdate of the contract. Pushdate reserves the right to terminate the contract, without notice, if it observes that the service setting up procedures described in the Service setting up schedule, were not complied with by the affiliate during the 3 weeks following contract signature.

6. Activation of service
Activation of the service can be done jointly by Pushdate and the affiliate within 48 to 72 hours following fulfillment of the actions stipulated in the Setting up the Service annex to the contract (for further details on integration procedures, click here).

7. Maintenance of the dating service
After placing on line, all subdomain dating service maintenance reserved for affiliates is assured by Pushdate, i.e.
- complete maintenance of servers and bandwidth costs,
- moderation of ad texts and photos before publication,
- user assistance.

8. Maintenance of service customization elements
After placing the site on line, and in accordance with the specifications of the technical customization options adopted and documented in the Setting up the Service annex, the affiliate shall see to the good technical maintenance of the pages or codes created,not hosted in its pushdate.com subdomain (pages or codes for its ads, events, etc.)

9. Quality of services and technical services
Pushdate shall do everything required to assure the permanence and continuity of the proposed service.
Pushdate shall not be held liable for service inaccessibility due to technical malfunctions, it being specified however that it has the right to exceptionally and briefly suspend access to its services for eventual maintenance operations or improvements to its services.
Owing to the characteristics and limits of the Internet, of which the affiliate declares having full knowledge, Pushdate cannot be held liable notably for difficulties in accessing the subdomain of the affiliate due to network saturation during certain periods. Pushdate shall do everything reasonably possible to design, develop and maintain the service, affiliate subdomain administration functionalities.

10. Ownership, copyright
The affiliate acknowledges having no ownership of elements, texts, photos, data, page layouts presented in the subdomain created on the Pushdate servers apart from illustrations and photos that the affiliate has the possibility of placing for customization of the subdomain. All technical and visual architecture of the subdomain is the property of Pushdate. The affiliate shall also refrain from offering or distributing the content and texts presented outside the framework of this affiliation contract without the express and contractual approval of Pushdate.

11. Responsibility of the affiliate within the framework of the editing and customization of the service.
Affiliates have editing tools placed at their disposal by Pushdate in a secure administration area. The editing of these texts must respect the Pushdate ethics charter, a precondition of membership. The affiliate is fully responsible for the publication of illustrations or photos. Pushdate cannot be held responsible for any third party litigation dealing with intellectual property and image rights.

12. Liability of Pushdate on the content published in the affiliate's Pushdate subdomain. In no case - apart from affiliate responsibilities in the customization of the latter's subdomain (11) - shall the affiliate be held liable for any litigation that may arise from the display of data and photos from the Pushdate network.
